Using ORDSHARK
These terms govern use of ordshark.com and describe the general conditions for engaging ORDSHARK for technology, design, development and related services. ORDSHARK is the brand used on this website. The legal identity of the service provider should be identified in each project agreement.
Submitting an inquiry does not create a contract or guarantee acceptance of a project. A separately agreed written proposal or statement of work will govern the specific engagement.
Project proposals and acceptance
Before starting a project, we provide or agree on a written scope covering deliverables, pricing, schedule, assumptions and responsibilities. A project is accepted when the relevant parties confirm the agreement in writing.
We reserve the right to decline proposed engagements where requirements, availability or other legitimate considerations prevent acceptance.
100% advance payment
Full advance payment is a mandatory standard condition. Unless expressly agreed otherwise in a separate written agreement, 100% of the agreed project fee must be received and confirmed before ORDSHARK begins design, development, implementation or any other project execution.
Sending an inquiry, accepting a quotation or providing a payment screenshot does not constitute confirmed payment. Work begins only when the agreed scope is finalised, required materials are available and the full payment has cleared.
Taxes, payment processing charges, domains, hosting, software licences and third-party subscriptions are handled according to the accepted proposal.
Scope and additional work
The agreed fee covers only the features, deliverables, revisions and services expressly included in the approved project scope.
Additional features, significant scope changes or new requirements require written approval and may require additional payment before the additional work begins.
Client responsibilities
Clients must provide accurate instructions, necessary project information, lawful content, appropriate permissions, timely feedback and access to required systems.
Clients are responsible for ensuring they have rights to the material they provide. Delayed approvals, missing materials or changed requirements may affect delivery dates.
Timelines, reviews and delivery
Delivery dates are estimates unless expressly guaranteed in writing. Timelines may depend on client approvals, project complexity and external platform requirements.
Revision rounds, acceptance criteria, handover arrangements and post-launch support are determined by the approved project agreement. Ongoing maintenance is not included unless specified.
Intellectual property
Clients retain ownership of materials they provide. Ownership or licensing of completed project-specific deliverables is governed by the signed or otherwise accepted written agreement.
ORDSHARK retains rights to its pre-existing tools, reusable components, methods and know-how unless expressly agreed otherwise. Third-party software, libraries and assets remain subject to their respective licences.
Confidentiality and security
Both parties should take reasonable care to protect confidential business and technical information shared during a project. Specific confidentiality commitments may be documented separately.
Please do not submit passwords, payment card details or highly sensitive information using the public inquiry form.
Cancellation and refunds
Cancellation requests should be made in writing. Requests received before project execution begins will be reviewed promptly, taking account of any lawful, unavoidable and clearly disclosed costs.
If work has started, any refund or amount retained will be evaluated fairly based on work performed, deliverables supplied, reasonable non-recoverable expenses and actual cancellation-related losses. ORDSHARK will not seek double recovery.
The advance-payment requirement does not constitute an unconditional no-refunds policy. Nothing in these terms removes mandatory statutory or consumer rights.
Third-party services
Hosting, domains, application stores, APIs, payment services and external platforms operate under their own terms and availability. Additional charges may apply.
Unless specifically guaranteed in writing, ORDSHARK does not promise particular search rankings, app-store approvals, third-party uptime or commercial outcomes.
Professional standards and liability
We aim to deliver services with reasonable professional care. Specific warranties, support obligations and remedies should be defined in the project agreement.
Nothing in these terms excludes rights or liability that applicable law prohibits excluding or limiting.
Updates and contact
We may update these website terms to reflect changes to services or legal requirements. Changes to existing paid engagements should be addressed through their agreed project documentation.
